The Bar Association of Hong Kong has stated its support for the criminalization of bid-rigging activities through amendments to the Competition Ordinance, following recommendations from its task force on law review. This task force proposed approximately 50 legislative amendments after the tragic Wang Fuk Court fire, covering areas such as bid-rigging, tender specifications, declaration of interests, and project safety and risks. Jose-Antonio Maurellet, the chairman of the association, emphasized the need for a dual-track system where civil and criminal proceedings should not be initiated simultaneously for the same case. Maurellet stressed that the authorities must coordinate to decide whether a case should be handled through civil enforcement or criminal prosecution. Under the proposed new criminal offence, the association highlighted the necessity of clearly defining the elements of the crime, including the precise definition of bid-rigging and the standards for proof. Furthermore, the association recommended amending the Building Management Ordinance to require the submission of tenders in "two envelopes" for projects exceeding a certain value. The price proposal envelope could only be opened after the technical proposal had met a specific score, encouraging a focus on quality rather than just price.
